DWI

If you’ve received a ticket for driving while under the influence (“DWI”) of alcohol, narcotics, or other drugs in New Jersey I can defend your rights in court. Repeat offenses can lead to suspension of your driving privileges and other serious penalties.

The law has changed in 2023. Ignition interlock devices are not encouraged by the State of New Jersey. Here is the amended statute. The Administrative Office of the Courts made some changes to the way these cases are handled in the municipal courts in February 2024.

The law concerning refusal to take a breathalyzer test has also changed.

Here are the New Jersey Attorney General’s guidelines for the prosecution of cases under the DWI laws. This link is to the official web site. Keep in mind these have not been updated since 2005.

Here is the standard refusal statement in use since 2012. This is also from the official web site.
